Erik Davila, of Ottumwa, was sentenced this week to a 50 year prison term for the murder of 24 year old Hugo Hernandez at a party in March of 2016. Davila, found guilty of 2nd degree murder last month in Wapello County court, had initially been charged with 1st degree murder. Attorneys successfully argued a diminished capacity defense, claiming that Davila was intoxicated to a level that lessened his liability. A 1st degree murder conviction would have meant a life sentence without parole. The second degree murder conviction means Davila will become eligible for parole after serving 35 years. His sentence also included an order to pay restitution to the Hernandez family of $150,000.
